MUSHE — COMBINED TERMS & CONDITIONS OF SALE AND VOUCHER USE

These Terms and Conditions (“Terms”) govern all Mushe services, including:

  1. Sales and service transactions with corporate, organisational, and individual clients (“Clients”), and
  2. The purchase, issuance, use, and redemption of Mushe digital vouchers (“Vouchers”) by users and recipients (“Users”).


By transacting with Mushe or by purchasing, receiving, or redeeming a Mushe Voucher, you agree to be bound by these Terms.


The Client expressly waives any of its own terms and conditions, even if issued after these Terms. Any deviation must be agreed to in writing by Mushe.

1. DEFINITIONS

  • “Mushe” refers to the Mushe digital voucher platform operated by [Insert Company Name].
  • “Client” refers to any individual, business, organisation, or institution purchasing Vouchers or related services from Mushe.
  • “Voucher” means a closed-loop, digital, prepaid eVoucher or gift card issued by Mushe and redeemable only at Partner Merchants.
  • “Partner Merchants” means businesses approved by Mushe to accept Vouchers as payment.
  • “User” means the individual who buys, receives, or redeems a Voucher.

2. NATURE OF MUSHE VOUCHERS


2.1 Mushe Vouchers operate strictly in a closed-loop environment, redeemable only at participating Partner Merchants.

2.2 Each Voucher is a stand-alone store of value; Mushe does not operate e-wallets or stored-value accounts.

2.3 Vouchers are not cash, not electronic money, not transferable, and not a money-transfer service.

2.4 Vouchers cannot be used outside the Mushe Partner Merchant network.

3. FEES AND CHARGES (FOR CLIENTS PURCHASING VOUCHERS)


3.1 Platform Fee:

A standard platform fee of $2 per voucher applies to all purchases.


3.2 Payment Gateway Fees:

All third-party gateway fees (Stripe, PayPal, etc.) are paid by the Client in addition to Mushe’s platform fee.


3.3 Redemption Fee:

A fee of $0.15 per redemption applies and is payable by the Voucher redeemer at the point of use.


3.4 Transfer Fees:

Mushe Vouchers are non-transferable; thus no transfer fees apply.

4. VOUCHER VALIDITY & EXPIRY


5.1 Each Voucher is valid for 30 days from issuance.

5.2 After expiry, unused value is forfeited permanently.

5.3 Mushe is not required to notify Users of upcoming expiries.

5.4 Expired Vouchers cannot be reinstated, refunded, or replaced.

5. NON-TRANSFERABILITY


6.1 Mushe Vouchers are non-transferable.

6.2 Users may not transfer, resell, gift, trade, or exchange Vouchers.

6.3 Any attempted transfer will void the Voucher.

6. REDEMPTION


7.1 Vouchers may be redeemed only at Partner Merchants shown on the Mushe platform.

7.2 Partner Merchants may require digital verification.

7.3 Mushe is not responsible for:

  • the quality of goods or services,
  • pricing or stock availability,
  • merchant operational issues.


7.4 Redemption is final.

7. MERCHANT PREPAYMENT & SETTLEMENT


8.1 Mushe pre-pays Partner Merchants for voucher value.

8.2 Mushe does not hold User or Client funds, does not offer deposits, and does not provide settlement services.

8. LOST OR STOLEN VOUCHERS


9.1 Users are responsible for safeguarding their Voucher codes.

9.2 Mushe is not liable for loss due to:

  • lost codes,
  • theft,
  • unauthorised use,
  • fraudulent redemption.


9.3 Reissue may be offered only if the Voucher is unused and the User can verify ownership.

9. REFUNDS AND CANCELLATIONS


10.1 All voucher sales are final.

10.2 Mushe does not refund:

  • unused vouchers,
  • expired vouchers,
  • mistaken purchases,
  • change-of-mind decisions,
  • dissatisfaction with merchant goods/services.

10. CHANGES TO PARTNER MERCHANTS


11.1 The Partner Merchant list may change without notice.

11.2 Mushe is not liable if a merchant becomes unavailable.

11. COMPLIANCE & PROHIBITED USE


Mushe vouchers may not be used for:

  • unlawful activity,
  • fraud or attempted fraud,
  • money laundering,
  • commercial resale,
  • behaviour violating Zimbabwean law.


Mushe may suspend or cancel Vouchers in cases of misuse.

12. DATA PROTECTION (ZIMBABWE COMPLIANT + OPTIONAL GDPR WHERE APPLICABLE)


12.1 Zimbabwe Data Protection Compliance

Mushe complies with Zimbabwe’s Cyber and Data Protection Act (Chapter 12:07) in the collection, processing, and safeguarding of personal data.


12.2 Data Usage Purpose

Personal data is collected solely to process transactions, support clients, manage vouchers, and improve services.


12.3 User Rights (Zimbabwe)

Users have the right to:

  • request access to personal data,
  • request correction of inaccurate data,
  • request deletion or restriction where applicable under Zimbabwean law.

12.4 Data Retention

Mushe retains data only as long as necessary for legal, operational, or compliance purposes.


12.5 Data Sharing

Data is shared only with payment processors, Partner Merchants (where necessary for redemption), or authorities where legally required.


12.6 Security Measures

Mushe applies strong technical and organisational security controls to protect personal information.


12.7 GDPR (Where Applicable)

For Clients or Users in the European Union, or where required contractually, Mushe additionally aligns with GDPR principles, including data portability and objection rights.

13. SERVICE OBLIGATIONS & LIMITATION OF LIABILITY


13.1 Mushe services operate on a best-effort basis.

13.2 Mushe is not liable for:

  • indirect or consequential losses,
  • loss of business or savings,
  • merchant issues,
  • network or technical outages.


13.3 Where liability cannot be excluded, it is limited to the original voucher value.

14. CLAIMS


14.1 Claims must be submitted in writing to Mushe within 8 days of the issue.

14.2 Claims received after this period cannot be processed.

15. AMENDMENTS


Mushe may update these Terms at any time. Updated Terms take effect upon publication on the platform.

16. GOVERNING LAW


These Terms are governed exclusively by the laws of Zimbabwe.

Disputes shall be resolved under Zimbabwean jurisdiction.
